By accessing or using any part of this website or purchasing products from Homer hub, you engage in our service and agree to be bound by these Terms and Conditions ("Terms"). These Terms govern all users of the site, including but not limited to customers, vendors, and contributors.

2. Registration and Account

3. Product Information and Availability

• Product Descriptions: Homer hub strives to provide accurate descriptions, including color and size details, of all products. However, we do not guarantee the accuracy of product images or descriptions as they may vary depending on your device's display settings.

• Limited Quantities: Certain products may be available exclusively online or in limited quantities. Homer hub reserves the right to limit the quantities of any products or services we offer.

• Pricing: All prices listed are in Australian Dollars (AUD) and exclude GST unless stated otherwise. Prices are subject to change at any time without notice.

• Samples: Homer hub offers a sample program where you can purchase up to 5 samples for $15. This amount is refundable upon your full purchase of $99 or more (excluding GST and delivery fees). This offer is valid for 6 months from the date of your sample order.

4. Orders and Acceptance

• Order Placement: When you place an order, you are making an offer to purchase the goods at the prices listed, subject to these Terms. Once the order is placed, you will receive an email confirming receipt of your order.

• Order Acceptance: Your order will be accepted when we send you an email confirmation. Acceptance of payment does not constitute acceptance of the order. Homer hub reserves the right to decline any order for any reason.

• Amendments: Once your order has been confirmed, you may not change or cancel it unless explicitly stated otherwise.

5. Delivery and Shipping

• Delivery Time: Homer hub strives to fulfill all orders within the estimated timeframes but does not guarantee delivery dates. We are not liable for any delays caused by factors outside our control, such as shipping delays, natural disasters, or force majeure events.

• Shipping Fees: Shipping costs are calculated at checkout based on delivery address and order size. Delivery charges are separate from the cost of goods and are non-refundable.

• Risk of Loss: Title to products and risk of loss pass to you upon delivery to the address specified in your order. We are not responsible for any damages or loss that occurs after delivery.

6. Inspection and Acceptance of Goods

Upon delivery, you should immediately inspect the goods for any damage or discrepancies. If the goods are damaged or incorrect, you must notify us within 2 business days of receipt. Claims for damaged or incorrect goods must include detailed photographs for insurance purposes. Failure to report damage within this time frame may void any claim.

7. Returns and Refunds

Homer hub accepts returns in accordance with our Returns and Refunds Policy. Returns are subject to the following conditions:

• Return Period: Returns must be initiated within 14 days of delivery.

• Restocking Fee: A 25% restocking fee will apply to all returns.

• Condition of Goods: Items must be in original, undamaged packaging and in resalable condition.

• Non-returnable Items: Products that have been installed, altered, or damaged after delivery are not eligible for return.

• Damaged or Faulty Goods: If your goods are damaged, incorrect, or faulty, Homer hub will arrange return shipping and replacement or refund as applicable. Please provide photographic evidence of the issue.

• Return Delivery Responsibility: You are responsible for managing and paying for the return delivery of the items unless they are faulty or incorrect. We recommend using a tracked courier service to ensure the safe return of goods.

• Shipping Costs: The customer is responsible for return shipping costs, unless the goods were defective or incorrect.

8. Cancellation of Orders

You may cancel your order within 2 business days of placing it, provided the goods have not been dispatched. Orders canceled after dispatch will not be accepted, and shipping charges may apply.

9. Limitation of Liability

To the fullest extent permitted by law, Homer hub's liability for any claim arising from your use of the website or products is limited to the amount you paid for the product. We are not responsible for any incidental, indirect, or consequential damages arising from delays, damages, or losses.

10. Privacy and Data Protection

We collect and process your personal data in accordance with our Privacy Policy, which is incorporated by reference into these Terms. By using this website, you consent to the collection and use of your personal data as outlined in the Privacy Policy.

11. Force Majeure

Homer hub shall not be liable for any failure or delay in fulfilling its obligations under these Terms due to any cause beyond its reasonable control, including but not limited to natural disasters, acts of government, Labor strikes, and other unforeseen events.

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts located in New South Wales.

13. Dispute Resolution

Any dispute or claim arising out of or in connection with these Terms shall be resolved through mediation or arbitration as per the applicable laws. In the event that mediation or arbitration fails, the matter may be taken to court.

14. General Provisions

• Entire Agreement: These Terms represent the entire agreement between you and Homer hub and supersede all prior agreements.

• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full effect.

• Amendments: Homer hub reserves the right to modify or update these Terms at any time. You will be notified of any changes via email or notice on the website.
